Answers before you call

I was already denied. Is it too late to get help?

No — most of the people we help were denied first. You have 60 days from the date on your denial letter to appeal, so call us as soon as you receive it. If more than 60 days have passed, don't give up: in some cases the deadline can be extended, and if not, we can help you file a new application the right way.

How long does the process take?

An initial decision usually takes several months. If a claim is denied and goes to a hearing, the full process can take a year or longer. The biggest cause of delay is missing or incomplete medical records — which is exactly what we help you get right from the start. Certain serious conditions qualify for faster processing, and we will tell you if yours does.

Can I work while my claim is pending?

Be careful. Social Security sets a monthly earnings limit (called “substantial gainful activity”) that changes every year. Earning more than that limit will usually cause your claim to be denied, no matter how serious your condition is. Talk to us before accepting any work, even part-time.

What does “no fee unless you win” actually cost?

You never pay anything out of pocket. Representative fees are regulated by Social Security: the fee is a percentage of your past-due (back) benefits, up to a maximum amount set by SSA, and SSA must approve it. It is paid directly out of your back pay when you are approved. If you are not approved, there is no fee at all.

Do I need a lawyer, or can a consultant represent me?

You do not need a lawyer. Social Security authorizes qualified non-attorney representatives to handle your claim at every level — the application, reconsideration, and the hearing before an administrative law judge.
